Estate Administration
When a person dies somebody has to deal with their estate. Probate is the authority given by the court to a person or persons to administer the deceased’s estate. The document that is issued by the Probate Service is called a Grant of Representation. This document is usually required by the asset holders as proof to show the correct person or persons have the courts authority to administer the estate.
Probate - If the person who has died leaves a will
In this case one or more 'executors' may be named in the will to deal with the person's affairs after their death. The executor(s) will need to apply for a 'grant of probate' from the court. The grant is a legal document which confirms that the executor(s) has the authority to deal with the deceased person's estate. Sarah Edmunds can also help if you need a professional and legal will.
Letters of Administration - If the person who has died didn't leave a will
If there is no will, someone (usually a close relative(s) of the deceased) will apply to the Probate Registry to deal with the estate. The document issued by the Probate Registry is called a 'grant of letters of administration'. The people to whom the grant is given are called 'administrators' of the estate. Like the grant of probate, the grant of letters of administration is a legal document which confirms the administrator's authority to deal with the deceased’s estate.
